Terms Of Service


This ToS covers conditions for "I" the artist/creator, and "you" the client. If you have any questions regarding my ToS do not hesitate to ask.

Contact

  • Contact will be through whatever means I am originally contacted, or a mutually preferred form. Final files will be sent via email. Please don't ask me about updates unless you haven't had any communication from me for a couple of days.

Client's rights

  • Client's personal information will remain confidential, using only online names to refer to them. Client's private information will never be redistributed to third parties or stored by the artist.

  • Clients have the right to display, share and use the artwork they commission for personal use so long as the following conditions are met:

  • -Artist's signature/info is not removed, covered up or cropped out of the image. Exception being the use of cropped art as "avatars" or "icons".

  • -Client does not claim to have created the art.

  • -Client gives credit to artist as the creator.

  • -Client does not alter the art without prior permission. Doing so can result in blacklisting and DMCA of the edited art.

  • -Client does not attempt to sell prints or use for other commercial gains using the art without previously purchasing commercial rights. Use on platforms in which the client receives money (twitch, youtube, patreon, ect) will be considered a violation of the ToS.

  • -Client does not have authority to use/mint my art in blockchain technology without buying full rights of the artwork. (And even then, I'd really rather you didn't.)

Artist's Rights

  • Commissioning me for art means buying my time and services to create said artwork. All rights to the art remain with me, the creator, unless the client buys the rights for an additional fee. (Tips or unspecified extra payment does not count.) The request for private art (meaning it is not posted anywhere by anyone, including myself) will fall under the same category and must be bought for the same additional fee.

  • I have the right to refuse any commission offer, without justification or explanation.

Minors, Split Commissions and Secondary Clients

  • By commissioning a mature image, you are agreeing that you are at least 18 and not a minor or purchasing said art for a minor! If I find out this is not the case, I will immediately cancel your commission, refund the commission, and blacklist you from commissioning me again. I will further report your minor status to the website you contacted me from. You have been warned.

  • Split Commissions in which multiple people are paying will be literally split into separate payments. Should one person cancel the commission, all parties will be refunded unless discussed by the remaining clients. In the circumstance of one payment being sent that includes payment from other clients, should anything happen and I refund that payment, the original payment sender is responsible for delivering individual funds from said refund to the other parties.

  • Secondary clients are those who are not directly paying for the artwork, but do have a character of theirs included. Secondary clients will be given WIPs at the same time as the primary (paying) client(s) but should be aware that I am not being paid by them, and will listen first and foremost to the primary client.

Payment and Refunds

  • Payment is expected within 48 hours of invoice being received. Some leniency is possible if payment delay is discussed beforehand.

  • A rough sketch will be provided and approved before an invoice is sent.* Invoices will be clearly labeled with the agreed on price and include a copy of this ToS. Linework will not begin until payment is received. If an invoice is not paid within three days past the agreed on time, the commission will be canceled. Clients do not have any right to the concept sketch if there is no payment.

  • Should the client initiate an unsolicited or inappropriate** dispute, claim or charge back either through the payment processor, their bank or their credit card and succeed in reclaiming their payment, the client forfeits all right to display, share or use my artwork.

  • *Exceptions to this rule are YCH (Your Character Here) slots and wing-it style commission, which are payment up front.

  • **Referring to lack of justification of the dispute, claim or charge back. Justifiable situations include my prolonged disappearance (over two weeks) after attempted contact by you and incomplete work within the last 30 days of PayPal's protection window. (Currently 180 days.)

WIPs and Edits

  • Each step of the process will be approved via WIP before I continue to the next.* Edits can be made for each step, mostly in the sketch phase. I'm more than happy to tweak things in each step, however please be prompt in your need for corrections. Leaving something noticeably wrong in the sketch and asking for it changed when I start coloring is incredibly frustrating and causes serious delays in my work.

  • *Exceptions to this rule are wing-it style commissions. Those will only be edited if I missed a detail clearly defined on the reference provided.
